     A comment on Samuel Wilson's FindAGrave memorial is: "This Samuel Wilson was not married to Rebecca Smithson (I never said he was but apparently someone is confused about this.) from TX State Hist Assn: [quote]THIRTY-FIFTH TEXAS CAVALRY [BROWN'S]. The Thirty-fifth Texas Cavalry (Brown's) organized in October 1863. As there were two units with the number designation of the Thirty-fifth Texas Cavalry, this unit was named after its leader Reuben R. Brown. The other Thirty-fifth Texas Cavalry (Likens's) was led by Col. James B. Likens. When Reuben R. Brown was promoted to colonel, he was placed in charge of a newly-organized battalion that was made of the remnants of his Twelfth Texas Cavalry (Brown's), Rountree's Texas Cavalry, and an assortment of men who wanted to transfer from the Thirteenth Texas Infantry into a mounted unit. The Thirty-fifth was broken down into thirteen companies, some of which shared the geographic origins of its men. For example, Company A, the former core of the Thirteenth Texas Infantry, was known as the "Columbia Blues," since they had formed in Columbia, Texas. Company B was predominately from Brazoria and Colorado counties. Company C men were from Starr and Milam counties. Companies D and F held men from Navarro and Colorado counties. Company G held men from Hardin, Brazoria, and Matagorda counties. Finally Company H held men from Galveston and Fayette counties.
The leader of the unit, Reuben R. Brown, arrived in Texas in 1835 and took part in the ill-fated Matamoros Expedition of 1835–36. In carrying out raids for horses in South Texas, he escaped the battle at Agua Dulce Creek but was captured and brought before Mexican Gen. José Urrea. Eventually, he was taken as one of the Matamoros prisoners and held captive for eleven months before he escaped. Though he initially returned to his home state of North Carolina, he was soon back in Texas, where he owned a plantation in Brazoria County. Early in the Civil War he was assigned the Twelfth Texas Cavalry Battalion.
At the time of its organization, Brown's Thirty-fifth was composed of 927 men, including supporting officers Lt. Col. Stephen William [S. W.] Perkins (often misconstrued as Samuel W. Perkins), and Maj. Lee C. Rountree. The battalion's first duty was to challenge the Federal encampment at Fort Esperanza, located in Matagorda Bay. This fort, which had been recaptured by the Union earlier that year, was a direct threat to Indianola, one of Texas's largest seaports. Although an action was made, on December 29, 1863, the defenses of the fort proved too strong. Through desertion and casualties, Brown found his Thirty-fifth reduced to only twenty-nine officers and 409 men after the affair at Indianola. On February 22, 1864, it fell into the position of sentinel of the coast. Although Brown's Thirty-fifth officially surrendered with the other Trans-Mississippi units at Galveston on June 2, 1865, many of its units had unofficially disbanded in mid-May.

Attached to the Trans-Mississippi Department, it served in Texas guarding the coast between Galveston and Matagorda. In April, 1864, the regiment contained 18 officers and 334 men, and in April, 1865, there were 392 present for duty. It was included in the surrender in June. The field officers were Colonel Joseph Bates; Lieutenant Colonels Reuben R. Brown and Henry P. Cayce; and Majors Robert L. Foard, Stephen S. Perry, and Lee C. Rountree.41,42,43,44

Evidence for paternity of John Henry: I am now convinced that the preponderance of the evidence I have found supports the conclusion that John Henry ROBERTS (JHR, ca 1867-1928) is the youngest child of Elijah Josiah ROBERTS (EJR, 1823-1868) and his SECOND wife Luticia Frances HIGGINBOTHAM (LFH, 1836-1877). The evidence supporting this conclusion is as follows:

     1.     JHR and EJR were both in Cherokee Co., TX around the time of JHR's birth (ca 1867). JHR claimed to have been born in Cherokee Co., TX (per his children who informed his death certificate and obituary). EJR and his family were in the 1860 federal census for Shady Grove, Cherokee Co. TX.
     2.     The probate record for EJR's estate mentions "5 minor children" (unnamed) when recorded on 28 December 1868. Only four minor children of EJR living in Dec 1868 have been otherwise identified, leaving the possibility that JHR was the fifth minor child (another child, Elijah Columby, died as an infant in 1864):

     4.     A John Roberts (DOB 1865) appears in the household of a John T Wilson as a "orphan" farm worker in the 1870 census of Kaufman Co., TX. Coincidentally, the apparent location of the Wilson household is not far from the home of Emma Franklin, who JHR married in 1890
     5.     In the 1900 Census (Navarro Co., TX), JHR gives his parent's birthplaces both as AL. LFH was in fact born in AL, however EJH was born in TN. Since JHR's father EJR died in 1868 when JHR was between 1 and 4 years old, it is not unusual that he got his father's home state wrong.
     6. And Most Importantly: Because of the uncertainty of John Henry Roberts' parentage, a cousin and I have been trying to use DNA analysis to draw some conclusion as to which ROBERTS clan he might have descended from. We have three DNA samples on FTDNA and have accumulated a few matches to other likely links to the line of Elizah Josiah Roberts and his ancestors, the man I currently presume to be John Henry's father, but nother conclusive. I've here attached a chart showing some of that research. More recently (2 Feb 2019) Ancestry has published a DNA result that shows the link between the DNA samples of my mother and myself with the earlier Roberts of Elijah and the HIGGINBOTHAM line of his wife, Luticia. Graphics of these DNA analysis results are attached. I now feel that the link between and Elijah and Luticia (HIGGINBOTHAM) ROBERTS as the parents of John Henry ROBERTS is confirmed.

The only contrary evidence that I have found against this conclusion has to do with inconsistencies in the various records for JHR's DOB. However, I believe that the lack of consistency between the various records actually weakens the strength of these facts as contradictory evidence and that the Ancestry DNA matches confirm the link of John Henry to Elijah and Luticia as his prents.

The few contradicions are:
     1.     JHR's 1928 obituary gives his date of birth (DOB) as March 17, 1867.
     2.     EJR's other youngest child was born 21 Aug 1864 according to cemetery records, which if correct, precludes a 1860 DOB for JHR unless they were twins (for which there is no evidence).
     3.     The 1870 census (Rusk Co., TX, dated 22 Sep 1870) gives his age as 6 implying a DOB of ca 1864.
     4.     The 1880 census (Kaufman Co., TX, dated 23 June 1880) gives his age as 15 implying a DOB of ca 1865.
     5.     The 1900 census (Navarro Co., TX) gives his DOB as "March 1864".
     6.     The 1910 census (Comanche Co., TX, dated 24 May, 1910) gives his age as 44 implying a DOB of ca 1866.
