"In the name of God Amen I Thomas Sims Sener of Bromfield Parish and County of Culpeper being Sick and weak in body but of perfect mind and memory Thanks be given to God Therefore Calling to mind the Mortality of my body and knowing that it is Appointed for all men once to die do make and Ordain This my last Will and Testament that is to say Principally and first of all I do give and Recommend my soul into the hand of the Almighty God that gave it and my body I recommend to the Earth to be buried in a decent Christian Burial at the Discretion of my Executors nothing doubting but at the General Resurrection I shall reieve the same again by the Mighty power of God and as touching such worldly Estate wherewith it hath pleased God to bless me in this life I give devise and Despose of the same in the following Manner and form Imprimis.

No evidence of the relationship of John Sims (Mentioned in the will) to Thomas Sims Sr. has been found. However, since Anne Graves received an equal share of the estate with other children of Thomas, she evidently was a daughter.

"In the name of God Amen I Thomas Sims Sener of Bromfield Parish and County of Culpeper being Sick and weak in body but of perfect mind and memory Thanks be given to God Therefore Calling to mind the Mortality of my body and knowing that it is Appointed for all men once to die do make and Ordain This my last Will and Testament that is to say Principally and first of all I do give and Recommend my soul into the hand of the Almighty God that gave it and my body I recommend to the Earth to be buried in a decent Christian Burial at the Discretion of my Executors nothing doubting but at the General Resurrection I shall reieve the same again by the Mighty power of God and as touching such worldly Estate wherewith it hath pleased God to bless me in this life I give devise and Despose of the same in the following Manner and form Imprimis.

Item Secondly I do give and bequeath to my son James Sims my negro man Peter and all that fell to him by Division to him and his Heirs Lawfully begotten forever

Likewise I do give and bequeath to Elizabeth Sims wife of James Sims my Gilt Looking Glass and I desire at her Death that one of her sons may have it.

Item Thirdly I do give and bequeath to my son Elijah Sims the land he lives on The Gardon excepted and Likewise a Negro boy by name Abraham and all that fell to him by Division to him and his heirs sons of his first wife Lawfully begotten forever-

This last Will and Testament of Thomas Sims Decd was Exhibited to the Court by thomas Sims one of the Exors therein named and was proved by the Oaths of Edwd Sims & William Mason two of the Witnesses thereto & Ordered to be recorded; and on the motion of the said Executor Certificate is granted them for obtaining a probate thereof in due form they having made oath thereto and given bond & Security according to Law Liberty being reserved for the other Exor therin named to Qualify when he may think fit.

No evidence of the relationship of John Sims (Mentioned in the will) to Thomas Sims Sr. has been found. However, since Anne Graves received an equal share of the estate with other children of Thomas, she evidently was a daughter.

Alot of controversy exists concerning the the identification of Rebecca Sims mother. While most reseachers agree that her father was Thomas Sims (1696-21 April 1784), there seems to be several schools of thought concerning his wife.

The first theory explored is that Rebecca was the daughter of William Sims and brother to Thomas Sims (husband of Rebecca Petty, John Petty's sister). In his will, William Sims names only his son Thomas, a minor. Thomas Pety witnessed this will, 11 years prior to the marriage of his daughter Rebecca to Thomas Sims, thereby establishing a close relationship between the families early on. William Sims had other children not named in the will. On Feb. 1, 1714/5, William Sims in Richmond Co. deeded by gift land to sons-in-law Matthew Beane and Thomas Scott. Matthew Beane had married Mary Sims in 1710. A third daughter Rebecca, wife of John Pettey, has been suggested based on two 1734 deeds between Alexander Spotswood and John Pettey and Thomas Sims in St. Marks Parish, Spotsylvania County, naming Rebecca as the wife of John Petty. In my opinion, this is a very reasonable theory and seems to be the opinion mostly supported by Sims family researchers

One opinion is that Rebecca Sims' mother was Rebecca Petty, sister to her husband John Petty. One fact stated is that when Thomas Sims leased land from Alexander Spotswood (23 October 1734) the same day that land was leased from Spotswood by Thomas Pettey and his wife, Catherine, and son Christopher, William, Jeremiah and Elijah Morton, all on the S. side of the Rapidan River and by John Petty, wife Rebecca and son Thomas on the N. side of the river seems to be one thing that would bolster this opinion. These researchers are of the opinion that Rebeckah Simms mentioned in the Paul Harrelson will of 1734 was the wife of a Thomas Sims who was a descendant of the Thomas Symes - Amy Bridges family. This relationship has been published in several family histories including "Simms Family Genealogy", by Albert E. Simms Jr. and "Ancestors and Descendants of Thomas Sims of Culpeper County, Virginia" published by Prewitt in 1972. It seems highly unlikely, in my opinion, that John Petty married his sister's daughter.

The more recent view is that Rebecca Sims' mother was Rebecca Harralson, daughter of Paul Harralson. The basis for this information is the will of Paul Harralson, in which he names his granddaughter Rebecca Sims. The daughters given name and her husband were not named; but a Thomas Sims (presumed to be the one under discussion) lived nearby and circumstantial evidence can be developed that points to the possibility that this Thomas was the son-in-law of Paul Harralson and the father of Rebecca Sims. Do we know that this is the same Rebecca Sims as named in Paul Harralson's will? Other than circumstantial evidence is there anything else to comfirm that Rebecca Harralson married this Thomas Sims? This view is taken by most Petty family researchers.

Though I have listed Rebecca Sims mother as Rebecca Harralson, in my opinion, the relationship is not proven without further documentation. It does appear that there were two Thomas Sims living in the same general location and time period. Evidently one of these Thomas' married Rebecca Petty while the other married Rebecca Harralson. Without further documentation or insight, sorting out these families will be very difficult.

Item I give and bequeath to my son JOSEPH TOWLES my dividend of land begining at the mouth of the Little Run and runing from thence the several courses up the said Run to the Mountain ground, from thence up the Hollow to JOHN LAYTONs line .. And the -rest of the land which I had of THOS. WALKER from the South side of sd run and so up the run the several courses of the sd John Laytons line I give to ISAAC MEDLEY .. Item I give to my youngest Son HENRY TOWLES the old negro man named Charles. Item I give to my well beloved Wife JANE TOWLES and the Towle children which I had by her, MARY TOWLES & HENRY TOWLES, three feather beds and furniture; Item I give to my wife and the two children I had by her fourteen head of cattle such as she thinks proper; and likewise all my sheep, Horse & Mair & Saddles, Cart and wheels; also my crop of Tobacco, Corn and Wheat and all other grain with all the fodder , and likewise all the goods that I have sent for to Liverpool by Capt. GAYWORTH; all my hoggs & the crop of cotten. In the Name of God Amen. I STOKELY TOWLES of County of Cuilpepper and Parish of Brumfield being sick and weak of body but in perfect Sence and memory do make this my last Will and Testament ..
Item I give and bequeath to my son JOSEPH TOWLES my dividend of land begining at the mouth of the Little Run and runing from thence the several courses up the said Run to the Mountain ground, from thence up the Hollow to JOHN LAYTONs line .. And the -rest of the land which I had of THOS. WALKER from the South side of sd run and so up the run the several courses of the sd John Laytons line I give to ISAAC MEDLEY ..
Item I give to my youngest Son HENRY TOWLES the old negro man named Charles.
Item I give to my well beloved Wife JANE TOWLES and the Towle children which I had by her, MARY TOWLES & HENRY TOWLES, three feather beds and furniture;
Item I give to my wife and the two children I had by her fourteen head of cattle such as she thinks proper; and likewise all my sheep, Horse & Mair & Saddles, Cart and wheels; also my crop of Tobacco, Corn and Wheat and all other grain with all the fodder , and likewise all the goods that I have sent for to Liverpool by Capt. GAYWORTH; all my hoggs & the crop of cotten.
Item I give to my wife and the two children I had by her my chest of Draws Walnut chest one looking glass three iron potts such as she thinks fit to chuse; also two scillets and two tables and half my chairs to her liking; and half of my pewter all my Tin pans and all my Bee hives and all my wodden ware with all fowls and all the Fowles upon the Plantation and all the Beef and Bacon that is killed in the House and about Four Pistoles I have owing to me which I give to my youngest son Henry Towles which I desire for to give him Learning; and two Spining wheels one Linnen wheel and the other a woollan one; And three glass bottles, and if either of those two children Mary Towles or Henry Towles should die before they come to Man and Woman Estate that part of the said Estate shall to the other; And my desire is that the rest of my Estate Except the above mentioned Legaces may be equally devided amongst all my children old & young but I desire that the said Estate may not come to an appraisement, and I appoint SPENCER BOBO and my Wife Jane Towles Executer and Executress to this my last Will and Testament As witness my hand this Fifteenth day of January 1757.

I RICHARD SIMMS of the County of Culpeper, do make this my Last Will and Testament, as herein after mentioned.
First I desire that my Executors herein after mentioned shall sell so much of my Estate as will be sufficeient to pay all my just debts, and after the said debts are paid, I do lend unto my beloved wife MARY SIMS all of the balance of my Estate boath Rale and personal for her proper use, as well as for the purposes of Raising her Infant children, during her Widowhood, and in case she should marry, it is my desire, that in that case she should then take one third of my said Estate to her use during her natural life, and after her death to be equally divided amongst my children hereafter mentioned as well as the other two thirds of my Estate except a small Legacy that I leave to my three youngest children, independent of their full equal share of the ballance of my Estate with the rest of their Brothers and Sisters.

First that when my Son ROBERT Terrell SIMS comes of age it is my will and desire that he shall have a Horse of forty dollars value, also when my Daughter MARY FOSTER SIMS comes of age or marry, that she shall receive Forty Dollars, also when my Son RICHARD MERLIN SIMS comes of age he shall have a Horse of Forty Dollars value, and also that my sons EDMUND SIMS and GARNET SIMS shall at the Division of my Estate receive Forty Dollars each independent of their full equal share with the rest of their Brothers and Sisters, it is also my will and desire that after the death of my beloved Wife Mary Sims that the ballance of my Estate after paying the several Legacees before mentioned shall be be equally divided between my several children hereafter named that is to say JOSEPH T. SIMS, HENRY SIMS, SALLY BUTLER, EDMUND SIMS, ANNE COLLINS, NANCY TUCKER, GARNETT SIMS, ROBERT Terrell SIMS, MARY FOSTER SIMS, RICHARD MERLIN SIMS.
I do hereby appoint my Wife Mary Sims, my son Joseph Sims and my Son in law AARON BUTLER [or Amon Butler] my Executors of this my Last Will and Testament as Witness my hand and seal this 16th day of April 1809.

In the name of God. I JOHN WETHERALL of St. Marks Parish in the County of Culpeper being sick & weak but of sound mind and memory .. constitute and appoint this my last Will and Testament .. Imprimis I recommend my soul to God who gave it .. my body to be Interred at the discretion of my Executors hereinafter named and what worldly goods
Item 1st. I give and bequeath to my loving son GEORGE WETHERALL the two negroes now in his possession ( named) immediately after the expiration of the year of our Lord one thousand seven hundred & Sixty Eight together with said Sarah's child if any she heth at that time and of the age of Twelve months paying the midwife who shall deliver her of the same, also my gun, dictionary & Great Bible (saving and reserving to my wife the use of the said Bible during her Widowhood) also my new wearing cloaths to him & his heirs and assigns forever with my Still & Utensils.
Item 2d. I give and bequeath to my loving wife MARGARET one third part of all my household goods and stocks of all sorts to her and her heirs forever.
Item 3d. I give and bequeath to my loving children SARAH & JOHN all the rest of my Negroes (not before given) and their increase to be equally divided between them as well in respect to their Quantity as quality to be valued by persons to be appointed by the Court when my said daughter, Sarah, shall arive to the age of Eighteen years which will happen in the year of our Lord one thousand seven hundred & seventy six and upon such division if there be any difference in the value of the lots of the negroes as aforesd the child who shall have the lott of greatest valaue shall pay the other child as much money as will be sufficient to make them equal, also I give and bequeath to my said children Sarah & John the other two third of any household goods and stocks of all sorts to be equally divided between them ( in such manner and at such time as the Negroes aforesaid are to be divided) to them and their heirs forever.
Item 4th. I give and bequeath to my two sons GEORGE & JOHN my tract of land which I bought of THOMAS COVINGTON containing four hundred acres lying & being in the Parish & County aforesaid on the Branches of Mountain Run whereon one PRYOR formerly lived the Quitrents and Taxes on one moiety thereof to be paid annually out of my Estate on the Profits thereof during the minority of my said son John to be equally devided between my said sons to them and their heirs forever my son George to have and hold his moiety thereof immediately he paying the quitrents & taxes which shall become due thereon.
Item 5th, I lend unto my loving wife the Lott & Plantation whereon I now live during her life But in case my Landlord COLO. CARTER should dispossess her of the lott and plantation aforesaid that then she enter upon have hold and Enjoy the said moiety of the four hundred acres of land above mentioned belonging to my son John until he arrive to Lawful] age and further my will and desire that the negroes, household (goods & stock belonging to my said children ( to wit) Sarah & John be by my wife kept together for hers and their support maintenance & education of my said children and in case the stocks aforesaid grow to great to be supported by the Negroes of my last mentioned children that then the surplus part thereof be sold and the money arising therefrom be divided between my said two young children, my said wife not wasting nor suffering the estate of my said two children to be wasted.
And lastly I do hereby appoint my loving Son George Wetherall and my Trusty Friends NATHANIEL PENDLETON & WILLIAM WILLIAMS Executors of this my last Will and Testament. In Witness whereof I have hereunto set my hand and seal this 26th day of September 1762.
NB the words during the minority of my said son John Interlines and the Erasement in the fourth Item of my last Will were both done before signed.

SAR Application says b. 1760-1770. Early Col. Settlers has two rouchly contemporary Anne GATEWOODs, one b. 1750 and one b. c1746 (who m. Francis NALLE, William's father. I now think that the Anne GATEWOOD b. in 1750 was William's mother, while his wife was more likely born 1760-1770 and her parents are still unknown. As she is referred to his William's cousin (whether 1st or 2nd cousin is unclear), she could be the daughter of one of her mother's siblings.1,2,6 She married William Nalle, son of Capt. Francis Nalle and Anne Gatewood, circa 1796
