IN THE NAME OF GOD Amen I FRANCYS COLE of the County of Lancaster in Rappahannock River being sick & weak in body but of sound & pfect memory (God be praised) do make & ordain this my last Will &Testamt. in manner & form following.
First I commend my soul into the hands of Almighty God my creator & redeemer, my body to the Earth from whence it came and for such worldly goods as it hath pleased God to bless me withall I dispose of the same as followeth
First I give & bequeath unto my loveing Wife, ALICE COLE, all that Plantation whereon I now live with all housus edifices & buildings thereunto belonging & appertaining To have & to hold the same unto her & her assignes dureing her natural life in case she continues a Widow, but in case my Wife happen to marry after my decease I give her only one third part of my sd Plantation houseing & buildings thereunto belonging To have & to hold the said third part dureing her natural life
Item I give unto my sd Wife, ALICE, one full third part of all my female cattle whatsoever to her her heirs Exrs. Admrs & assignes forever
Item I give unto my sd Wife all my male Cattle with all my hogs whatsoever to have & to hold the sd male Cattle & hogs to her forever
Item I give unto my sd Wife one third part of all my household stuf Implements of household whatsoever being in or belonging to me or my now dwelling house
Item I give unto my Wife my two Negroes Henry & Peter their labour for seven years from & after my decease in case my Wife shall so long live & from & after the decease of my sd Wife or the expiration of the sd seven years which shall first happen, I give the sd Negro Henry to my Daughter, FRANCYS, & the Negro peter to my Daughter, MARY, their Exrs. Admrs. & assignes severally forever and I give unto my sd Wife my three English Servts, to her & her assignes for ever, But my will & meaning is & I do hereby give unto my said Daughter, FRANCYS, at her day of Marriage two of the aforesd. English Servants or two other Servts. to be provided at the costs & charges of my sd Wife
Item I give unto my sd two Daughters, FRANCYS & MARY COLE, from & after the decease of my sd Wife or day of Marriage wch. shall first happen all that Plantation whereon I now live together with all my other Plantation adjoyning containing in the whole by estimation Five hundred acres more or less, To have & to hold the sd Five hundred acres of land withall housing edifices & buildings & all other the appurtenances whatsoever thereunto belonging & appertaining unto my sd two Daughters, FRANCYS & MARY. their heirs & assignes for ever to be equally divided between them and if it happen either of my sd two Daughters to decease without issue of her body lawfully begotten I give her part of the sd land to the surivour hir heirs & assignes forever but in case my Daughter marry before the decease of my Wife or her day of Marriage my will & meaning is & I do hereby give unto my said Daughter, FRANCYS, at her day of marriage the use of my uper Plantation until she shall be possessed of the one halfe of the aforesd. Item I give unto my two Daughters, FRANCYS & MARY, two thirds of all my female Cattle together with two thirds of all my household stuf & Implements of household to he equally divided between them within some reasonable time after my decease To have & to hold the sd two thirds of my sd female cattle & household stuf to my sd two Daughters, FRANCYS & MARY, their Exrs, Admrs. & assignes forever, But if either of my sd two Daughters shall happen to depart this life without issue of her body lawfully begottin I give her part to the survivour her Exrs. Admrs. & assignes for ever, my will & meaning is taht in case Negroes do come in this year, two Negroes shall be bought out of my p:sent Crop & I do give the sd two Negroes to my sd two Daughters, FRANCYS & MARY, but in case Negroes do not come in this year, I dispose of my sd p:sent Crop between my Wife & my two Daughters to be equally divided between them

Witnesseth that whereas said John Curtis only Surviveing Brother and next of kin unto ELIZABETH HAZELLWOOD deced Daughter and Heir of ABRAHAM MOON late.of ye County of LANCASTER deced made the claime of right unto the escheat of Fourteen hundred acres of land in County of Lancaster (now Middlesex) first granted unto the said Abraham Moon and THOMAS GRIFFIN by a certain Patent or Deed of Grant dated the 16th of September 1651 and supposed to be contained within the bounds of one certaine Patent or Deed of Grant for Seventeen hundred acres of land in Parish of Christ Church in the County of Middx first granted unto Abraham Moone deced by Patent dated the last day of March 1653, which said Seventeen hundred acres of land by virtue of an Inquisition taken on the 7th day of May 1697 before RICHD. JOHNSON Esqr. then Escheator for the aforesaid County of Middlesex was found to escheat unto his Majty. and was granted unto RALPH WORMELEY Esqr. deced Father unto the aforesaid Ralph Wormeley party to these presents by Patent dated the 15th of October 1698 as by said Patents remaining upon records of the Generall Court of this Dominion NOW KNOW YEE that I the said John Curtis for sum of one hundred and twenty pounds Steil, hath released unto Ralph Wormeley (in his full and peaceable possession being) and to his heires forever all the right claime and demand whatsoever which said John Curtis now hath in the before recited Patent for Fourteen hundred acres of land also all his right and demand which he now hath in the before recited Patent for Seventeen hundred acres of land . Whereas Jno Gfiffing late of Essex decd., by deed dated 10 Dec. 1695 sold the said William Ayres 200 acres. This land adjoining the line of Wm Tomlin, the line-of John Daingerfield, Tignor's Creek, the line of Joseph Reves, etc., and being part of 830 acres in Essex which said John Griffin (sic) bought of Edward Sorrell and Alice-his wife, Executors of the will of the aforesaid Benj: Goodrich decd, by deed of sale acknowledged in the General Court 27 April 1695, and also their deed of confirmation 17 October next, This deed now for further confirming the sale of the 200 acres to Ayres.

JOSEPH GOODRICH in his life time (to wit) ye fifth day of Febry: in ye year of our Lord God 1691/2, did receive of ye Plt, ye sum of One thousand seven hundred & ninety pounds of sweet sented tobo: in consideracon & for satisfaction whereof ye sd JOS: GOODRICH did oblige himselfe to enfeoffe & confirm unto ye Plt. One hundred acres of land by as ample a conveyance as the Law in that case directs, or otherwise to repay ye Plt. ye aforesd sum of Tobo: back againe, most of which pr:misses by a certaine Note under ye hand of him ye sd GOODRICH bearing date ye day & year aforesd., & here in Court produced will more at large appear; yet notwth:standing the aforesd. To Mr. John Daingerfield 250 acres of Land of that Tract of Land called the Range Land the said 250 acres of Land to be on that side the said Tract next to the Land that Bryan Ward now liveth on.
To Jeremiah Parker 250 acres of Land of the same Tract Called ye Range and Joyning to the above said 250 bequeathed to Mr. John Daingerfield. The residue of the above Tract of Land called ye Range all whole and singular with the appurtenances (saving and Excepting what is above bequeathed) to my Loving sister Dorothy Boyces als Browne.
To my God daughter Sarah Shipley daughter of Daniel Shipley 250 acres of Land that I hold by Patent and Conveyance Lying in this County of Rappa on the south side of the River in the Parish of South ffarnham and Joyning to the Land of Mr. Joseph Goodrich and the Land of Thomas Wood.
To Frances Daingerfield daughter of Mr. John Daingerfield one gold ring with three barn and a stone in it being the least of three rings that I have.
I will that my horses and mares and what Debts are due unto me go to pay my Debts with all and the residue of my personall Estate after my Debts are paid I give and bequeath to my beloved sister Dorothy Boyces als Browne.
Executrix my sister Dorothy Boyces als Browne and Mr. John Daingerfield to join with her as overseer and assistant. What Tobb. of mine in the hands of Mr. John Daingerfield be by him expended and disburst in the Paying of my sisters passage into the country.
I will that my man Grace be and remain wth Mr John Daingerfield until my sister comes into this country unless he can dispose of him on a good Acct: towards the defraying of charges either of my sisters Passage or other charges that he may be at in the Managing my Estate in whose hands (to wit) Mr John Daingerfield I will that my Estate may remaine until my sister may arrive in Virginia. Requests that Mr John Daingerfield see that his funeral be solemnized at the house where he dies and that a funeral sermon be Preached for him at the Lower Church of Sittingburne Parish at the first opportunity of a Minister. If my sister should not come into the Country Then my will is that my Land that is not already above bequeathed (to wit) the Residue of that Tract of Land called the Range be disposed of and I do dispose of it thus Viz.: I give unto Mr John Daingerfields children 800 acres of the said Land Residue to be equally divided between them and to Thomas Parkers children 800 acres of the said Land to be equally divided between them and to Daniel Shipleys children 900 acres of the said Land to be equally divided between them being 3000 acres in the whole.

- WILLIAM RUST of the County of WESTMORELAND brought his action in this Court against THOMAS PARKER and declares that a Horse the right and property of the CompIt. about two years old black in colour and branded with his own proper brand on the near Shoulder being a Cross, about six years since with other Horses out of the said County of WESTMORELAND went a way into the County of Richmond and sometime after his going away did sell the woods about TOTUSKEY in the said County and that the sd THOMAS PARKER unlawfully hath taken into his custody the said Horse and the same unlawfully doth detaine and keep and to his own use convert to the CompIts, damage One thousand five hundred pounds of tobacco for which he craves Judgment with costs the Defendt. pleades Not Guilty, and for tryal puts him self together with the CompIt. upon the Country, Whereupon it is ordered that the Sheriff summon twelve good and lawfull men of the County to try the matter in issue, who being impannelled and sworne by name EDWARD JEFFERYS, JOHN RANKIN, JAMES ORCHARD, JOHN TRAPLEY, JOSEPH DIKE, DENNIS CAMERON, RICHARD HARMAN, PETER FOXEN, WILLIAM CAMBELL JOHN SYMONS, THOMAS HEWES and NICHOLAS SMITH, brought in this following verdict (We of the Jury find no cause of action), which verdict this Court have confirmed and Order the suit to be dismist, the Plantiff pay all costs als. ex.

Richmond County, VA, Order Book 2, 1694-1699, pages 99-100, Court dated 5-6 November 1695 - Thomas Parker as Marrying Belinda Pursell brought his action in this Court against William Jenkins, Executor of Martha Stopford, deceased and declares that the said Martha in her lifetime did contract and agree with the said Belinda to make a thorough cure of a certain sore leg that Henry the son of the aid Belinda was afflicted with, in consideration whereof the said Belinda did pass her Bill unto the said Martha for the payment of 700 or thereabouts, of tobacco, but that the said Martha in her lifetime in no wise regarding her said Agreement nor the performance of the said Cure so by her undertaken did wholly neglect the same and at the time of her decease left the said sore as bad, if not worse, as when she undertook it whereby the said Complainant was forced to be at great charge and expense to make the said cure, and therefore in fact saith that he is Damnified and damage hath sustained to the value of 1000 pounds of tobacco and therefore craves Judgment together with cost of suit; And the said William Jenkins comes into Court and pleads Not Guilty in manner and form; Wherefore the Sheriff of this County or his Deputy is commanded to summons 12 good and lawful men of the Vicinage to try the matter in issue who being impaneled and sworn by name, Ralph Whiting, Thomas Lewis, John Rankin, William Sims, Francis Suttle, Daniel Jackson, William Amon, Avery Nayler, Peter Evans, Thomas Newman, Charles Snead and Thomas Bradley brought in this following verdict, We of the Jury find for the Defendant, which verdict the Court do confirm and do dismiss the said suit with costs alias Execution.

Richmond County, VA, Order Book 5, 1708-1711, pages 73-74, Court held 4 August 1709 - John Pursell by his Petition setting forth that Thomas Parker, his brother by mother’s side, that she on her death bed left her son, Thomas Parker, unto the care and tuition of Henry Pursell, Elder Brother to Petitioner, who is since dead. Nevertheless one Joshua Lawson clandestinely and unknown to the Petitioner got him, said Thomas Parker, bound by this Worshipful Court, and since hath and doth still use the boy after an inhumane manner by tying him up by the arms and whipping unreasonably, pinching him, also both of diet and cloths and permitting a woman whom he keeps to use the boy after a barbarous manner so that the boy is almost at death’s door as in the Declaration is set forth. The said Lawson according to Order of last Court appearing but showing no sufficient cause why said Parker should not be discharged from any further service due to him by virtue of the aforesaid Order of Court, he is therefore discharged and ordered that he return home with said Pursell and appear here next Court.1

     Samuel Stephens (b.?1629 – 1669) was the Governor of the Albemarle Settlements (which would later become North Carolina) from 1667 until his death in late 1669. He was appointed by the Lords Proprietor to succeed William Drummond.
Early life and education
     Stephens was born in Jamestown, Virginia and was the first governor of any colony to be born in America. His parents were Richard Stephens and Elizabeth Piersey Stephens.
     In 1652, Stephens married Frances Culpepper, the sister of Lord John Culpeper. They had no children.[1] They owned Boldrup Plantation in Warwick County, Virginia.[2]
Career
     Before King Charles II of England established the Province of Carolina, Stephens had served as "Commander of the Southern Plantation" for the Colony of Virginia between 1662 and 1664. The "Southern Plantation" roughly corresponded to what would later be northeastern North Carolina.
Death
     Stephens died while serving as Governor.[1]

     Philip Cottington Ludwell (c. 1638 – c. 1723) was an English-born planter and politician in colonial Virginia who sat on the Virginia Governor's Council, the first of three generations of men with the same name to do so, and briefly served as speaker of the House of Burgesses. In addition to operating plantations in Virginia using enslaved labor, Ludwell also served as a governor of the Province of Carolina.
Early life and family
     Philip Ludwell was born in Bruton, Somerset, England. He emigrated to Virginia circa 1661, where his brother Thomas Ludwell was secretary of the colony, and fellow Bruton native William Berkeley served several terms as governor, first under the London Company, and then pursuant to royal commission after Virginia became a royal colony.[1][2]
     He married Lucy Higginson Burwell,[when?] the daughter of Captain Robert Higginson and widow of Major Lewis Burwell I and later of William Bernard. They had a son Philip Ludwell Jr. and a daughter Lucy who married future burgess Daniel Parke II, and whose daughter (also named Lucy) would marry William Byrd II.[citation needed]
Career
     In 1667, Philip Ludwell became captain of the James City County militia. After marrying his first wife and becoming the guardian for her son Lewis Burwell who had not reached legal age, he operated Fairfield, the Burwell family's plantation on Carter's Creek in Gloucester County, probably until about 1675 (both her death and when her son Lewis Burwell reached legal age and married for the first time).[1]
     Ludwell patented large areas of land, and probably lived for a time with his brother Thomas at Rich Neck Plantation in James City County near Jamestown.[1]
     In November 1674, Thomas Ludwell sailed to England, having authorized his brother to serve as the Virginia Colony's Deputy Secretary. In the mid-1670s, Philip Ludwell also appeared before Virginia's General Court to file audited accounts as well as filed lawsuits and present testimony, and also served as the colony's surveyor general. In 1675, he was named to the Council of State (both the upper house of the Virginia General Assembly and the advisory council to the governor) and would hold that position until 1677.[1][3]
     In 1676, both Ludwell brothers remained among the strongest supporters of Virginia governor William Berkeley during Bacon's Rebellion, named after the leader, a nephew of Lady Berkeley, and whom she would denounce as a scheming and ungrateful malcontent.[4] Col. Philip Ludwell led an unsuccessful raid upon Bacon's compound, before Bacon died of disease at what became known as Bacon's Castle.[5] Col. Ludwell also accompanied Governor Berkeley during his temporary exile to the Eastern Shore, during which time the rebels burned the colonial capital at Jamestown, as well as plundered Berkeley's Green Spring Plantation, Ludwell's plantation and goods, and those of his Burwell stepson and ward.[1]
     Both Ludwell brothers remained prominent residents of what some called Middle Plantation until 1677—both when Governor Berkeley died in London and Thomas Ludlow[clarification needed] died later in the year in Virginia. Ultimately, the colony's capital was reestablished very near Middle Plantation at Williamsburg, since stagnant water at Jamestown during summer months proved especially unhealthful.
     Philip Ludwell had witnessed Governor Berkeley's will in March 1677, and three years later he became the third husband of Berkeley's widow, Frances Culpeper Berkeley of Green Spring Plantation.[6] In the interim, Lady Berkeley had sailed to England after the rebellion, hoping to save her husband's reputation, but was unsuccessful and ended up sailing back to Virginia with his successor, Herbert Jeffreys. After quashing the rebellion, Lord Berkeley had been recalled and died in England in 1677. In 1680, the year of his second marriage, Philip Ludwell again became a member of the Governor's Council of State. Lady Berkeley, though now the colony's wealthiest person in Virginia (and with lands in North Carolina as well inherited from her first husband) and who remained so politically active that a faction was named after her main Green Spring plantation, continued to run her plantations using large numbers of slaves.[7][8]
     Not only was Lady Berkeley known as opinionated, Ludwell's continued outspoken views also put him at odds with Lt. Governor Herbert Jeffreys until Jeffrey's death and Ludwell's re-instatement to the Governor's Council upon petition of other burgesses.[9] The conflict recurred later with Governor Francis Howard, so that Ludwell was again suspended from the Governor's Council in 1688 but sailed to England with a petition for relief signed by several burgesses.[1][10] Thus, although James City County voters elected both Ludwell and James Bray Sr. to represent them in the House of Burgesses that year, Ludwell was not allowed to be seated (his son-in-law Daniel Parke won the new election and was seated).[11] Ludwell would again carry a petition of Burgesses and Lady Berkeley to England circa 1791, and received a vote of thanks and 250 pounds sterling for his efforts.[12]
     Despite her remarriage and moving for a time to the Ludwell plantation at Rich Neck, Lady Berkeley never relinquished her title as Lady Berkeley before her death (probably at Green Spring and probably in 1695, though she would be reburied at Jamestown). Since she had no surviving children from her prior marriages, nor the last, Ludlow inherited her property, including Green Spring, that she had inherited from Gov. Berkeley and from her first husband, North Carolina Gov. Samuel Stephens, and would in turn pass them onto his son by his first marriage, Philip Ludwell Jr.[1]
     In 1684 and 1685, after Governor Howard arrived in Virginia, Ludwell was hired to build and remodel the statehouse and secretary's office in Jamestown. Around 1691, Ludwell became Lord Fairfax's agent for the Northern Neck Proprietary. He also bought lots in Jamestown.[1]
     Through Lady Berkeley's efforts, the Lords Proprietor in London appointed Ludwell as governor of the Province of Carolina on both 5 December 1689 and again in November 1691. By this time, North Carolina residents had rebelled against the chaotic rule of Seth Sothel, who was sent into exile in 1689. Lady Berkeley's first husband Samuel Stephens had held a similar position as the 2nd governor of the Albemarle Sound colony, William Berkeley had been one of the Lords Proprietor until his death, and she had inherited land there, some of which Ludwell sold to other proprietors in 1689.[13][14] Ludwell managed to established a government for the northern part of the colony in Albemarle Sound in May 1690, despite Virginia emigrant John Gibbs' refusal to concede power. Gibbs had filled the power vacuum after Sothel's departure and argued that the colony's Fundamental Constitutions required a resident governor, which Ludwell would not be based on his marital and business interests. Both Gibbs and Ludwell sailed to London by year's end, where the Lords Proprietor disallowed Gibbs' claim. The Lords Proprietor then explicitly revoked the Fundamental Constitution and in November 1691 issued another commission to Ludwell with explicit power to appoint a deputy governor for northern Carolina, and expecting that he would make Charles Town the government seat. Ludwell soon appointed Thomas Jarvis as his deputy in North Carolina. He arrived in Charles Town in April 1692, published his new commission and established a government, although he found affairs there chaotic and after leaving affairs in the hands of Thomas Smith and promising to return in four months, returned to North Carolina (where Jarvis had fallen ill) and Virginia by May 1693.[15]
     Ludwell then returned to Virginia politics, won election as one of James City County's two delegates (alongside Poynes Weldon), and fellow Burgesses elected him as speaker in the 1695-1696 session before Ludwell again sailed to England.[16]
Later life and death
     Although the date remains unclear, Philip Ludlow returned to England permanently after his wife's death, after entrusting his Virginia plantations and other property to his son.[2]
     Now an elder gentleman, Ludlow died in England, possibly in his native Bruton in Somerset, as late as 1723 according to a letter sent to Philip Ludwell Jr. by an English relative. He is buried at the family vault in the Stratford-atte-Bow church in Middlesex (now east London).[2]

In the Name of God. I Alexander Parker of the County of Essex being of Sound & disposing mind & Memory do make this my last Will & Testament hereby revoking all other wills by me made[.]
Imprimis I give to my Loving wife Susanna during her natural life the Use of the following slaves that is to Say my Cook Wench Doindah, and her Daughter Sarah with all their future increase and after the death of my said Wife I give the said slaves and their increase to my Son Richard Parker forever[.] And Whereas before my marryage with my said Wife I agreed to leave her at my death all the household Goods stocks of Cattle Horses Sheep & hogs which She was possessed of at the time of my marriage with her and whereas for the performance of the said agreement I entered into a certain bond or obligation to the Honble John Robinson Esq. late of the County[.] And Whereas the Condition of the said Agreement and bond was or the part of My said Wife Susanna that she the said Susanna should not in case of my death make any Claim or demand to ___ or in any Dower or any other part or share of my Estate either Real or Personal now in performance of the said Agreement and also the Condition of the bond aforesaid. I here by give and bequeath to my said Wife all the household Goods Stocks of Cattle horses Sheep & hogs which she was possessed of at the time of my Marryage with her that is such of them as shall be in being at the time of my Death hereby declaring that what I have now given her by this my Will is intended in _____ & full satisfaction of her right of Dower and all other Claim and Claims of or in any Part of my Estate either Real or Personal being firmly persuaded that this agreement before my Marryage ought to take place according to the tenor of it and in Case the law will not preserve the force & Efficacy of it so as to make it binding on my said Wife that then I do hereby absolutely revoke and make void all the Legacies to her given as aforesaid.
Item I give to my Son Alexander Parker all my Drugs and Medicins Chirurgical instruments and books of Physick & surgery and all other my Utensils in my profession as Physician & Surgeon and Also all my Wearing Apparel[.] And as a Provision for my GrandSons William and Alexander sons of my said Son Alexander I do hereby give and bequeath to my Executors hereinafter mentioned the sum of three hundred Pounds Current Money of Virginia to be by them laid out as soon and Conveniency will admit of in lands and Negroes and to be so settled that division shall be made of such purchase as soon as either of my Grandsons shall arrive to the Age of twenty Years and if either of them shall dye before their arrival to such Age that then the whole of such purchase shall go to the Survivor of the two and if both of my Grandsons shall dye before they arrive to the Age of twenty one years that then the whole of such Purchase I hereby give to my Son Alexander & his heirs forever & further it is my Will & meaning that my said Son Alexander shall have the use of such land & slaves so purchased untill my said Grand Children shall arrive to their respective ages aforesaid but not with any power of passing or alienating such use to any other but purely that my Grandsons may be well maintained. I therefore desire & empower my Executors herein after mentioned at all times to interpose and prevent any such abuse of this my Will.
Item I give and bequeath to my Executors herein after mentioned the sum of three hundred Pounds Current money of Virginia to be by them laid out as soon as Conveniency will admit in land and slaves to be Settled on my Son William Parker and his heirs Forever and this I give to said son William over and above what I have already done for him either by Gift or otherwise as will appear by my Ledger ____
Item for the Performance of this my Will and for the payments of all my Just debts I give and bequeath to my good Friends Landon Carter Esq & John Tayloe Esq.. All my M____ lots lands & houses in the Town of Tappahannock & the lands I escheated near the said Town[.] To them the said Landon Carter & John Tayloe and the Surviver of them in trust to be by them sold and disposed off for ready money within two years after my decease at ____ either by Publick Action or in any other manner as they shall think fit and after the payment of my Debts & Legacies as aforesaid[.] I do order that the residue of the money arising from such sales and all other my moneys Arising from bonds bills or Accounts due to me be laid out by the said Landon Carter & John Tayloe Esqs in Lands & Slaves Which land and Slaves when Purchased[.] It is my Will and intent that they be settled on my Son Richard Parker and his heirs forever.
Item I give all the Residue of my Estate either real or Personal be it of what Kind soever to my said Son Richard Parker & his heirs forever but if my said Son Richard Parker should dye before he arrives to the age of twenty one years and without leaving Lawful issue Then all that I have given him by this Will I give to be equally divided between my Son Alexander & William and their heirs forever[.] Lastly I do appoint the said Landon Carter & the said John Tayloe Esqs Executors of this my last Will and testament Guardians to my Son Richard Parker intreating them to take the said Trouble and Charge upon them[.] And Whereas I have desired their Care in the laying out of certain Sums in lands & Slaves I do no intend to limit or direct them in Such Purchase beyond their own Prudence and Discretion and this I declare to be my last will and Testament to which I have set my hand and Seal this 2nd day of Dec. in the year of our Lord one Thousand Seven hundred fifty.
