This indenture made made this 28th day of May 1788 between Henry Lee and Matilda Lee his wife of Stratford in the Parish of Washington and County of Westmoreland of the one part and Daniel McCarty of the said parish and county of the other part. Whereas the said Matilda Lee wife of Henry Lee and Flora Lee wife of Ludwell Lee, daughter of the late Honble. Philip Ludwell Lee were seised of certain lands in the aforesaid county in fee as coheirs, and whereas a partition has been made by which a certain part was allotted unto the said Henry Lee and Matilda Lee his wife. Now this Indenture witnesseth that the said Henry Lee and Matilda Lee his wife being so seised and possessed of the said land, did sometime in 1787 by their deed of indenture conveyed unto Daniel McCarty a part of the said land, which deed was lost from the office of the county before it was recorded and the parties have mutually agreed it should be cancelled, and in consideration thereof and Henry Lee and Matilda Lee his wife in consideration of 47,700 pounds crop tobacco has sold to Daniel McCarty a part of the land above mentioned containing by an actual survey made by Thomas Sthreshley 238 ½ acres and bounded as follows: beginning at Green’s Run in the line of Mr. Smith’s now McCarty’s and with the said line North 41° East 319 poles to Potomac River, South 3 ½° East 214 pole crossing Green’s Run a little before the fork of the said to a chestnut and a small dogwood near the top of a steep hill South 21 ½° West 132 poles crossing Smith’s road to a red oak near the nead of a small branch, then down the several meanders of the said branch 152 pole to Green’s Run, then down the meanders of the said run 46 poles to the beginning. In witness whereof the said Henry Lee and Matilda Lee have hereunto set their hands and seals the day and year first above written.
