In the name of God Amen. I FRANCIS KIRTLEY being through ye abundant mercey of God in perfect health of body & mind & of perfect sence Blessed by God but calling to mind ye certainty of death & the uncertainty of life Do therefore constitute and appoint this to be my last Will and Testament and desire it may be received by all as such as I do utterly revoke all former Wills by me heretofore made. Imprimis I give my body to the Ground from whence it was taken .. & as formy Burial I desire it may be Decent without Pomp or State at the Discretion of my dear Wife & Executors hereafter named. item I give & bequeath to my dearly beloved Wife MARGARET KIRTLEY one negro girl named Suck to her & her heirs forever. !also lend my dearly beloved Wife during her life one negro fellow named Shaddock & an Negro Wench named Doll, one feather bed & fur niture. her choice, one chest ,two pots, two dishes, half a dozen plates, two bosons, one pail & piggin, two cows & calves her choice half a dozen sheep, one mare known by the name of Pleasure & side saddle, half dozen chairs, & the rents of the lands & plantations whereon JOHN MACARTIE & JOHN FORESTER now lives during her life & at her decease the land whereon John Macartie lives to fall to my son WILLIAM KIRTLEY & the said land whereon John Forester now lives to fall to my son JAMES KIRTLEY to them and their heirs forever & the remainder to be sold to the highest bidder & the money to be equally divided among my children, to wit, WILLIAM KIRTLEY, THOMAS KIRTLEY, FRANCIS KIRTLEY & JAMES KIRTLEY, SARAH COWHARD and MARY COLLINS.

Item It is my desire that JONATHAN COWHARD shall keep the Plan & land whereon he now lives & quietly possess the same till the year one Thousand seven hundred & sixty eight for the Rent of his Plantation at Swift Run Gap which Rent is to be paid to JAMES KIRTLEY.
Item I leave all the remainder of my Estate, Land, Negroes, Goods & chattels to be sold to the highest bidder at Twelve months credit and the money thereby arising to discharge all my Just debts & the remainder to be Equally divided amongst my dear wife & children before named.

Note:
Often, when land went back to his Lordship, it did so for want of heir.
(Kilty: Land-holder's Assistant, pp. 173-177), as it could do and did do in
feudal England. In the Thimbleby case, Mary Browne became the substantial
owner of a hundred and fifty acres of Potomac River land, under the will of
John Thimbleby, one of the original grantees. Next, Mary married Thomas
Kertley. Next, she had a son, William. Then she died. Then William died.
The property came to William from his mother; it should have gone back to
his mother, since William died without issue (Coke on Littleton, Page 13). But
Mary, his mother, had died first and the fief was vacant. Thomas Kertley
wanted to be the new tenant. The Proprietary issued a mandamus to two
commissioners to determine who were the heirs of John Thimbleby and how
much the property was worth. By their inquisition, they found out the value
of the land and did not say who the heir was. The Provincial Court read and
heard the inquisition, and judged "that the One hundred & fifty acres of
la[nd] . . . is Escheated unto his Lordpp the Lord Proprietary for want of
heyre." But the escheat did not mean that the land stayed in the possession
of the Proprietary, for the tenant Kertley got a grant for it in his own name.
It was probably a petition from him that led to the mandamus, and he, as the
discoverer of the escheat, would be preferred if he then applied for a warrant
of resurvey (Kilty, Page 174). That he did so apply is shown in the St. Mary's
County rent roll (p. 25): "Honest Tom's Inheretance, surveyed . . . for
John Thimbelby and William Brown . . . and was after granted to Tho:
Kirtley." So Thomas Kertley obtained the land, in his own name (post,

     "Many reseachers have suspected that Stephen Franklin may somehow be connected to either Lawrence Franklin or Edward Franklin of Orange county, Virginia. Evidence has been lacking and recent Y-DNA tests seem to show that Stephen was not a direct male descendant of Lawrence or Edward. This does not mean he wasn't related though. A mysterious document in Stephen's pension file may demonstrate a connection. The document (photos of the orginial hand-written document) is attached in the Gallery for Stephen Franklin.
     "One side of the document has the supporting testimony of Benjamin Robinson. It appears that after he wrote this, the paper was folded and the other side was addressed to Bernard Franklin.
The paper states:
Fayette County, Ky Sept 2nd 1832
     "I do certify that I have known Stephen Franklin for at least forty years and I am witness that he served a tour of Duty at the Mouth of Kentucky River as a spy under Capt. Rhodes Thompson and Bartlett Collins.

I Stephen Franklin do testify that I spent one Month at Limestone officer [uncertain]

     "From the above we see that Benjamin Robinson was living in Fayette County, Kentucky in 1832. Why would the paper be addressed to Bernard Franklin? Perhaps he was to deliver the paper to the court in Anderson, KY.
     "A search of the 1830 US Census shows that a Bernard Franklin did live Fayette County, Kentucky in 1830. It appears that Bernard and his wife were living with a married child and their family. Who was this Bernard? He is Bernard Franklin Jr. the son of Bernard Franklin, son of Lawrence Franklin. He died a year later in 1833 in Fayette County, Kentucky. He was probably too old to take the paper to the court himself, but possibly the paper was given to a son to deliver — OR — it was not addressed to him specifically, but rather to his 33 year old son, Columbus Bernard Franklin, to take to the court.
     "Why would Benjamin Robinson give the paper to Bernard Franklin, rather than someone else to deliver? My guess is that Bernard was probably somehow related to Stephen Franklin. I think his name on the note adds weight to the idea that Stephen is related to the Franklins of Orange County. A relative would have the most incentive to make sure the paper got to the court in Anderson County and helped Stephen.
     "This doesn’t completely solved the mystery. While Bernard, the son of Lawrence, is the right age to be Stephen’s father, Stephen does not seem to be a direct male descendant of Lawrence or Bernard Franklin (as demonstrated by the Y-DNA test results of their descendants).
     "The next statement may be controversial to some, but it is possible that Stephen’s mother was an unmarried sister of Bernard, son of Lawrence. In those days, children of unmarried women generally took the mother’s surname. If Bernard's unmarried sister had a child, the child would have been given the last name of Franklin, and the results of a Y-DNA test would fail to register this connection to Bernard or Lawrence."3

State of Kentucky Anderson County
     On this 29th day of October 1833 personally appeared before 111e, AndreW McBrayer (?] Justice of the peace for Anderson County, Stephen Franklin a resident of the United States in the County of Anderson, State of Kentucky aged 72 years, vho being first duly sworn according to laW, cloth on his oath Make the folloWing declaration, in order to obtain the benefit of the Act of Congress, passed June 7th, 1832. That he entered the service of the United States under the following named officers viz. Colonel Frank Taylor [Francis Taylor], Lieutenant Garland Berley [Garland Buurnley] he entered the service under these officers some short time previous to the Battle of Kings Mountain October 7, 1780) Orange County Virginia, say twelve months or thereabouts but does not recollect the precise date or year. In this instance he was drafted & served six months under Colonel Taylor, but was in no engagement & during that time marched from Orange County to Albemarle where he aided in guarding Burgoyne's men at the Barracks near Charlottesville, he resided in Orange County State of Virginia: when he entered the service, Subsequent to the Battle of Kings Mountain, previous to & at the same Battle, he served, having been drafted he July previous to that Battle & served near two years under Colonel Benjamin Cleveland & Captain Larkin Cleveland. During the services under the above mentioned Officers he was in two Battles one on Catawba River & the other New River, at its head, he marchecl through parts of Virginia North Carolina South Carolina, he served in Cleveland's Regiment, 45 years ago he emigrated to Kentucky, where he was a spy in the Indian war, he was born in Orange County Virginia, but does not recollect the year, having no record of his age, it having been lost, he now lives in the County of Anderson State of Kentucky: old & ahnost helpless, not being able to walk in consequence of an attack of palsy, under which he is now laboring, he was we;l[ acquainted with Colonel Williain Sumpter [sic, Sumter] He got a discharge from Colonel Benjamin Cleveland & Captain L. Cleveland, which has been lost, he is known to Bennet Elders [?Siders, Leders, Suders ?] 1, & Francis Long, he relinquishes his eve1y claim whatever to any other pension than the one under the Act of 1832 June 7th the declarant says that he has no documentary evidence of his age, discharge &c.
