     "In the name of God Amen I Joshua HUDSON of the County of Amherst being weake of Body but of sound mind and memory, do make and Ordain this my last will and Testament in name and form following.
     To wit: It is my Will & desire that after my Decease my Body be intered in a decent and Christian like manner at the discretion of my Executors hereafter named. My soul I recommend to Almighty God hoping to find Mercy & forgiveness at his hands and as touching such worldly goods as it hath Pleased Almighty God to bless me I dispose of in manner following vist:
     Item: I give and bequeath to my Daughter Sarah WRIGHT five Shillings to be paid by my Executors out of my Estate having formerly giving her what I intended for her.

!I (and many members of the family) spent years looking for the father of Smith Shaw without success. In Oct, 1992, I visited Mississippi and Larry Carter and I, while examining old land records found that Smith Shaw bought land from a James Shaw (land that Larry Carter owns today). Later, I obtained a copy of pages from the Bible of Smith Shaw which has listed under "Deaths": "James Shaw died on the 4th of Dec 1866 aged 80 years". This lead me to belive that at least he was related. Then -- the breakthrough -- I learned from Karen Willis (on Prodigy) about him. The information fit together too well to be coincidence -- so I have entered her information as fact, even though I have not yet proved it.
!This is the info Karen Willis sent me: Benjamin Shaw, father of James Shaw is recorded in Salisbury District, Guilford Co., NC in 1790, 1800 census. He was a farmer and planter. In 1810, it appears John Shaw has taken in Benjamin's family - maybe John is the oldest son. James Shaw also appears here as between 16-26 years old. James was born 1786 in NC. He was a farmer and planter. He married Catherine Elliott, raised an orphan. Her DOB in VA Sep 8, 1793. She died July 17, 1875 and is buried in the Fox family cemetery in Kaufman Co. I have seen her grave. James died 1866 and is buried in Wilson Chapel Cemetery 5 miles south of Kaufman. After James' death Catherine lived with Elizabeth (Betsy) Fox and her husband Dr. Joseph Fox. They are my g-g-g-grandparents. Their children are: Elizabeth b 18 Dec 1810, NC d 17 Oct 1895 (1816 James paid taxes in Maury Co., TN. Rhoda b 21 Dec 1821 Alabama, William A. b 1827 AL, John 1829 AL, Smith between 120-1830 AL, Fox birth date unknown, Robert B. b 19 Jul 1833 Perry Co., AL. Elizabeth probably married Joseph Fox in Perry Co. for this is where their paths crossed. By June 1839 Shaws were in Aberdeen, Monroe Co., MS. Here, James purchased abt. 160 acres of land in the SE quarter of section 4, township 13s, range 7e. He received the land patent on Apr 9, 1842.
He sold the land the next day to Robert Cunningham for 1.00 per acre. 2 1/2 mo. earlier James presented a Deed of Gift to his grandchildren (Betsy and Joe Fox' kids) giving them "two mares branded J.S., one small colt and one bay colt" etc. The grandchildren ranged from 1-13 years old at the time the deed was given. The Foxes lived in Chickasaw Co., MS. Smith Shaw lived next door to Joseph Fox in the 1840 county census for Chickasaw. The rest of the Shaws (we don't know why) were still in Monroe Co. We believe the rest of the Shaws moved to Chickasaw in 1842 -- they are listed on the 1850 census there. James Shaw Jr. and his family lived next door to James and Catherine. William was a law student that year. Robert was a student. James Jr. was a farmer. While in MS James acquired 20-30 slaves. In June 1851 the Fox family had left Chickasaw Co. Smith Shaw remained there. In that same year James Sr. visited Kaufman Co. TX -- the same place the Foxes were headed for. When in Kaufman he bought 1500 acres of land at 1.00 an acre. Two years later James took his family, except Smith, by wagon train to Kaufman Co. TX. The 500 mile journey took one month. Catherine rode her horse side saddle and attached to her waist, lying in her lap was their bag of gold to establish themselves in the new area. It was a leather pouch measuring about 4" x 8". James followed behind. Catherine, or "old Grandma" as she was called was the supreme ruler - James was completely submissive." !This information taken from "The History Of Kaufman County Texas" without proof. It was very close to the same information above, but added, "James had acquired a moderate education and took up farming like his father. . . . He professed no religion, but was everywhere known for his strict honesty and integrity. . . . In Mississippi James Shaw became a man of influence and financial prestige. Here he had acquired real estate worth $6300 and slave propery of between twenty and thirty Negroes and mulattos."5 GAV-4.

"The NC Land Grants in Tennessee, 1778-1791 show that James Shaw had Grants #353 & 353 of 640 acres each on the northside Cumberland opposite Nashbro and on the fork between Cumberland and Red River. TN Territory was still a part of NC and TN did not become a state until 1796. James and Catherine Elliott SHAW moved to TN where their 2nd child, Julia, was born in 1814...James Shaw and his children and grandchildren all came to Kaufman Co., TX sometime in 1853-54 via wagons. James Shaw had bought 1,500 acres of land in Kaufman Co. and the hill between Kemp and Mabank on highway 175 is called Shaw Hill after the Shaw family."7

     I BENJAMIN SHAW, do by these presents make this my last will and give and do allow MATTHEW SHAW, the full privilege of the plantation where I now live to make a crop of every convenience that is, m--------- to accomplish the same un------- this year.
     2nd, I give to my [son] JAMES SHAW one dollar out of my estate.
     3rd, I give JONATHAN FISHER, formerly my son-in-law one dollar. [Husband of SARAH SHAW]
     4th, I give to my son NOBLE SHAW all the lands where he now lives by paying one hundred dollars to the balance of my estate.
     5th, I give to DRUSY WOOD and RHODA [SHAW] his wife, one-hundred and ten acres of land joining JARED PERKINS and FREDERICK DEEN in that lease.
     6th JAMES MORTON and MARY [SHAW] his wife, I give one hundred and forty-five acres of land beginning at a black oak south [IOURING?] HUNT and ISAAC STANLEY in that border of my land.
     7th I give MATTHEW SHAW two hundred dollars to be made out of my estates.
     8th, I give ROBERT NORDYKE and BETSY [ELIZABETH BETSY SHAW] two hundred dollars to be made out of my estate.
     The said moneys to MATTHEW SHAW and ROBERT NORDYKE to be paid by my representative fifty-dollars per year until paid up [by] my will, that is all my past debts should in the first place be paid out of my estate.
     I also will the balance of my estate to be equally divided between all my children except JAMES SHAW and JONATHAN FISHER.
     Lastly, I constitute and appoint my son AARON SHAW and my son-in-law JAMES MORTON as my executors to this my last will and witness in whereof I have set my hands and deal this fifth day of April 1830.

     This indenture made on this day of October on 1830 between Matthew Shaw and Noble Shaw and Aaron Shaw, Dausy Wood and his wife Rhoda [Shaw] of the one part, and James and his wife Mary [Shaw] of the other part all parties of the state of Carolina and Guilford County. All parties heirs of the late BENJAMIN SHAW deed have allotted and by mutual argument have divided the land of their dead father BENJAMIN SHAW will in faith that the said Matthew Shaw, Noble Shaw, Aaron Shaw, Dausy Wood and his wife Rhoda [Shaw], the receipt whereof is heirs by acknowledged, and the said Matthew Shaw, Noble Shaw, Aaron Shaw, Dausy and Rhoda [Shaw] his wife, doth hereby exonerated and agreed the said James Morton and Mary his wife their heirs and assigns forever all that piece tract and parcel of land situate being and being in our county of Guilford on the waters of Reedy Fork of Haw River.

     Raised an orphan: Tradition has that Catherine Elliott Shaw was an orphan and Census shows that she was born in Virginia. One story told about her by my Uncle Edwin (Ed) Carruthers, her great-grandson, was that when the family lived on Shaw Hill, in a log cabin, she hid their gold coins in between the logs for safe keeping.
     She road a horse to Texas when the family moved to Kaufman County to take up residence in their new home.

     "Family lore has always held that Catherine was "raised as an orphan." This did not mean in an orphanage. The Guilford County Court of Pleas and Quarter Sessions is full of cases where orphans were assigned to a family. Specific instructions were given by the court as to the care of the child. One sixteen year old orphan was bound to a man who was "to learn him the art mystery of a black smith as far as he is capable.. and to give him freedom dues of home Spun (clothing) and four Months Schooling.." Another three year old girl was to "be bound unto Thomas Kirkmand & wife untill she she [sic] arrives tot he age of 18 years and he is to larn hir to read and write and lern hir the art of a spinster and he is to Cloths his well and give heir a good spinning wheel & Cards and two suits of freedom Dress." (Seems like the court reporter needed more schooling...)
     "Catherine's name is not found in these court records. The only Elliott on the 1790 census is one Moses Elliott, and he is active in the court records until 1808. He is on the 1810 census, however, and on an 1814 muster roll for Guilford County. He's not our man. On the 1800 census, there is a John Elliott, and John is all over the county court records as well. But he and Moses are still around on the 1820 census.
     "I wonder if we actually know for certain that Catherine is from Guilford County? I think perhaps a search of surrounding counties court records might be in order. (Alamance, Caswell, Chatham, Davidson, Forsyth, Orange, Randolph, Rockingham and Stokes.) Neighboring Randolph County is faily thick with Elliots in 1790. Most of their records, however, seem to be missing. I think we'll never solve this mystery.
     "Jack Fox conducted an interview of Catherine's grandaughter-in-law, Vi Priddy Fox, and wrote the following about Betsy Shaw Fox and her mother, Catherine Elliott Shaw: "Her mother was "Old Grandma" Shaw (She was known to everyone by this name) and Grannie couldn't remember having ever heard her name. Old Grandma was ruler at her house and before her the husband, James Shaw, was completely submissive."7,8 GAV-4.

     Joseph Fox was born in London England, was orphaned about eleven years of age and lived with an aunt, Elizabeth Deeth. He ran away and sailed on a ship for 3 years, crossing the Atlantic several times. he rode the mast when the ship was rolling from side to side, and helped the ship's doctor and began to learn to be a doctor. He was shipwrecked on the Carolina coast, drifted to Alabama, Mississippi, then to Texas in 1851. He settled in Kaufman County.
     Marion Fox of Kaufman TX recalls that his grandfather Joseph Fox came from Okalona Miss and Julia Anne Fox Spikes, daughter of Joseph, often spoke of living at Aberdeen Miss.
     Joseph Fox began the practice of medicine among the Indians as it is told. After he moved to Kaufman County, he had a wide practice among the early settlers. Sometimes he would be gone from home as long as 3 weeks, people calling him from one home to another, often getting as far away as Henderson. He raised yellow horses and always rode one in his practice. he carried his pills in the saddle bags.
     He had married Elizabeth (Betsy) Shaw in Mississippi and they reared a large family of 7 boys and 5 girls. Two girls died young. Sarah K was the first person buried in the Fox Cemetery at Rand. He set aside land for this purpose. A historical marker was placed there in May 1968.
     He built his home about 1.5 miles east of Prospect (Now Rand), 9 miles east of Kaufman. The house was two log houses connected with a plank room, with a long porch across the front. He was a small man, blue eyes and fair hair. Dr Fox bought 2 sections of land from P H Pearson for $1.00 per acre. There were no fences except bois d'arc hedge and some rail fences.
     There were no banks, railroads, telephones or telegraphs, radios, televisions, roads or bridges. They sent by wagon train for groceries from Shreveport LA. They made their own cloth, thread, and clothes. Small game was plentiful and they raised their own grain.
     In Nov of 1977, the Marion Fox Farm was accepted in the TX Family Land Heritage Program for a century of more of continuous ownership and operation as a family agricultural enterprise. Agriculture Commissioner Reagan V Brown presented a certificate of honor to Mrs Pauline Fox Nichols. Co-owners include Mrs Lucille Fox Shiels, Stephenville and Robert marion Shiels, Ft Worth.
     This is part of the Joseph Fox Farm founded in 1851.

Info received from William D. McCain (letter dated 25 September 1990): Smith Shaw was in the cencus (sic) of 1840 of Chickasaw County under the description of "1 male over 20 and under 30." He was in the censuses of Chickasaw County in 1850, 1860, and 1870. I will attach his entry for 1870.

During trip to Van Vleet, MS in Oct, 1992, obtained copy of family Biblepages (Bible in possession of Shaw Bishop family--copies made by Kelli Carter). Written on front page: "Mr. Smith Shaw's Bible He was borned in 1816 He had two sons killed in war of 1863-64 I don't know how old this Bible is I am there (sic) youngest daughter & the only one living Mrs R L Bishop Houston Miss Nov 1952"

There was a family legend that he was accused of murder (of a carpetbagger or something similar). I have spent years researching this story and will add notes as I turn up info:

The "History Of Chickasaw County" says the murder of General Tucker is the only unsolved murder in Chickaswa County. He was shot in his Okolona living room through an open window.

In an interview, Shaw Bishop tols me that as a small boy, he was in bed but not asleep when his brother came in looking for "an old sheet or something to wrap up an old man named Stafford who had died in his cabin". Shaw said he heard his mother yell, "Just leave that old man lie -- he's the son of a bitch that set your grandpa up". Shaw said that is the only timne in his life he ever heard his mother cuss.

The (standard reference) book, "Generals In Gray" says William F. Tucker was murdered by "a man named Shaw" and gives the source as a granddaughter living in Okolona. Larry tried to find the source but she has moved away.

Larry Carter and I searched the court records at Ponotoc and found the Court Minutes, but the case file was missing; I plan to go back and sarch further. We also searched around in the attic of the Ponotoc Courthouse, and the jury room of the Okolona Courthouse -- to no avail. I have copies of what I could find. It appears the charge was against Smith Shaw and his son, Richard Shaw. Richard was tried and found not guilty. A few weeks later, charges were dropped against Smith.

July, 2000 -- Interviewed Louise Witt who said that when she was a teenaged girl, an old Civil War veteran, named Gordon but called "Old Soldier" told her about Smith SHAW being accused of murder. He said a man named Staffard died just before he was to testify, and confessed that he had done it himself. She said this all took place near Wesley Chapel, "where there were quite a few cabins at that time". Her folks got upset that he had told her, and he later apologized to her for telling her -- it was to remain a secret.6

George Turner Shaw began military service between 1861 and 1863 1861: George Turner SHAW
saw his uncle Lindsey Lafayette DAVIS fall at Sharpsburg (Antinem Creek) and later died at Gettysburg, probably during Pickett's Charge. George T. Shaw enlisted as a private at age 18 in 1861. He was elected 4th Corporal April 1862. On May 31 of that year he was wounded in the hip at the battle of Seven Pines. On July 3, 1863, he was killed at Gettysburg.

Camp near Martinsberg, Va.
Sept. the 24th, 1862

Dear Father:

I am happy to say to you all that I am still alive. I have fought a great many battles since I wrote to you before but I will not try to give any of the details this time as I am in a great hurry. We are under orders to march now and I do not think that I will soon get well.

Pa, I can not say to you that I am well, for I have been sick for the last two or three days with the fever, but I am glad to say that I am better and think I will soon get well. Pa, I received your letter of the 14th of August about a week ago. It was handed to me on the battlefield and I do not know when I ever felt so bad in my life before. You have had such bad luck this year with your family, and Oh, to hear of my dear little brother being dead. I wanted to see them so very bad but I hope there is a day coming when we shall all meet in Heaven, where there is no parting and I hope and pray you will have better health from this. Pa, you must not think hard of me for not writing to you before now for I never had time. We have been marching all time. I know you wanted to hear from me very bad, but it was impossible. You can tell Ma that her brave brother has fallen, that is Uncle Lin Davis. He was commanding the company that day and his company say that he was wounded very badly and we had to retreat and he was left on the field. He has made a good soldier and has been all the fights and fought bravely for his country, but he had to fall. I know that his connections will hate very much about him being left on the field, but it could not be helped. All the field officers from our regiment were wounded and killed, two of them left on the field, Col. Beetle and Major Evans. We could not get them. Col. Liddle was badly wounded. We had three killed out of our company and 8 or 9 wounded. Sam Wilson was wounded 3 times, but he was hurt bad. Pa, I saw John Maldon the day I got your last letter and told him to write to you for me, and he said he would. I told him to write for clothes, but you need not send them until you hear we are in camps, unless all the others send them. Pa, I am sorry that you have to leave home, but I can not get off and I don't know what Ma will do by herself, but I hope the just God will provide for us. Tell old Uncle John and the rest of the Negros that they must pray for me.

James Smith Shaw began military service between 25 April 1861 and 1862 James S. Shaw enlisted on April 25, 1861, in Corinth, Miss., at age 16. He was discharged six weeks later-one source says because he was disabled, another because he was underage. He later joined the 31st Mississippi and was killed (the record did not say where or when).4
